official guidelines for preferred custom home builders
1) Participation
- Carver Mountain will have no limit to the number of participating Preferred Builders in its Preferred Custom Builder Program.
2) Homesite Purchase / Construction Criteria
- The Preferred Builder program is open to any approved Preferred Builder building in Carver Mountain.
- Any qualified homesite purchase by the Preferred Builder will include a five percent (5%) Preferred Builder discount off the current listed price at the time of purchase, provided they remain qualified under the terms of the program. Preferred Builder must close on the homesite purchase within 45 days of contract signing or before October 1, 2007 whichever is later. If Preferred Builder purchases a second homesite simultaneously, a 7% discount off of the current list price will be offered along with a 90 day closing. If an additional homesite is purchased within 12 months of the initial purchase(s) then the 7% discount will also be offered but with a 45 day closing. Any subsequent homesite purchased beyond 12 months will revert back to a 5% discount. An earnest money deposit of $10,000 per lot is required.
- Qualification for the program will require that a Preferred Builder must always maintain a minimum inventory of one homesite. The Preferred Builder must begin construction on a home within 6 months of close of escrow of purchase.
3) Marketing and Advertising
- Carver Mountain is committed to strictly promoting the interests and goodwill of those custom builders who are active participants in the Preferred Custom Builder program. Preferred Builders will be placed on the formal list of "approved" builders at Carver Mountain, and will be the exclusive list distributed to all prospective buyers.
- Each Preferred Builder will be provided with an overview of the marketing plan, public relations strategy and the media schedule as it specifically relates to the Custom Home product offering.
- Carver Mountain will maintain a Community Information Center at the offices of Swenson Realty Group located at 5080 North 40th Street, Phoenix, AZ 85018. The Information Center will be staffed with a professionally trained sales associate on a by-appointment-only basis. A special area within the Information Center will be reserved for the Preferred Builders. This area will be used for merchandising and display material provided by the Preferred Builder. All displays must conform to established criteria and subject to the approval of the Developer. The costs of fabrication and installation will be the responsibility of the Preferred Builder. Display areas for architectural models will be considered on a space available basis.
- Collateral marketing materials will be created by the Developer and will include high quality master community information. This will also include special plot plan and pricing inserts for all custom homesites. Carver Mountain will create an overview of the features of the Preferred Builder program that will be of benefit to our custom home and homesite buyers. Carver Mountain will also create a standard insert for Preferred Builder inventory homes that will be re-printed with space for an illustration and specific information about the home offered. These inserts will be available to all Preferred Builders on an as-needed basis for display in the Information Center. The custom builder will also provide a Builder's Story to be a part of this two-sided insert marketing piece. The cost of the insert re-prints will be the responsibility of the Preferred Builder.
- From time to time, Carver Mountain will communicate with the existing lot owners, who have not yet built, to promote the Preferred Builders active in our community. Each Preferred Builder will also be featured on the Carver Mountain website, which will include any inventory homes currently available.
4) Broker Relations Program
- Carver Mountain is placing special emphasis on creating a high quality, personalized Broker Relations campaign. All Preferred Builder inventory homes will be part of the Carver Mountain Broker Relations Program. Particular and personalized attention shall be given to key brokers who have demonstrated custom home sales experienced and market activity.
5) Home Sales – Builder Representation
- Swenson Realty Group, Inc. ("Broker") is the exclusive listing agent for the custom home product offerings at Carver Mountain. Each Preferred Builder will execute an Exclusive Builder/Listing Agreement with Broker for the sale of any property within Carver Mountain subject to i) a sales commission of three percent (3%) of the total construction contract price (exclusive of the home site price) for all build to suit contracts generated by Preferred Builder, or ii) a sales commission of six percent (6%) of the total sales price (including all options and upgrades) for any inventory homes sold. Inventory homes are recognized as those homes built, under construction or planned to be built on any homesite owned by the Builder. Broker will pay at three percent (3%) co-broke commission to any participating broker in the event of a sale of a Preferred Builder home.
- Broker will exclusively list for sale only the inventory homes of the Preferred Builders and will display and provide information on the listed homes at all times in the Community Sales Center.
6) Property Signage
- Only Preferred Builder signs may be installed and only on a homesite owned by the Preferred Builder that has a home under construction. These signs are subject to the approval of Carver Mountain Homeowner's Association and will be fabricated and installed by the Association. The cost of the fabrication and installation of the signs is contained within the design review deposit that all Preferred Builders must pay to the Association.
7) Right to Modify
- Carver Mountain Limited Partnership reserves the right to modify the terms of the Preferred Builder program at any time.
